I encourage clients to work outside the court system using the Collaborative Family Law Process to make a Separation Agreement or a Marriage Contract/Cohabitation Agreement. Dealing with complex family law issues can be stressful and you need a lawyer to provide guidance and advice right when you need it most.
Collaborative Family Law
In Collaborative Family Law, clients agree to work together outside of court to resolve issues with the help of a team (lawyers, family & financial professionals). This process can be used for Separation Agreements as well as Marriage Contracts/Cohabitation Agreements.
The Collaborative Family Law process is not adversarial in nature so court is not used as a threat if a party is not willing to compromise. In this process, everyone negotiates in good faith, respect and cooperation focusing on what is best for the family especially the children. The Family professional helps clients work out a parenting schedule, and manage conflict. The Financial professional helps with financial disclosure for the division of property, support and equalization. The clients make the decisions, designing solutions that fit their family.
This process achieves the same outcome as Mediation but with the support of lawyers who provide legal advice, draft the domestic contract and with access to experts who help with parenting and property division. Not all mediation includes collecting financial information which is key to any family matter.
